Crane Trust Terms & Conditions - In consideration of being allowed to participate in experiences at the Platte River Whooping Crane Maintenance Trust (“Crane Trust”), I hereby agree to the following: I understand my experiences at the Crane Trust will have varying degrees of inherent risk and I fully assume the risks associated with participation in those activities. These risks include, but are not limited to, the risk of severe personal injury, permanent disability, or even death. I understand that situations may arise during my experience, which may be beyond the control of the Crane Trust, and may change the expected experience. I attest that I am eighteen (18) years of age or older and have no physical or medical condition, which would endanger others or myself or interfere with my ability to safely participate in the Crane Trust experiences for which I am registering. I acknowledge that I am capable of walking an extended distance over uneven grassland terrain, without assistance, in order to reach various destinations throughout my experience. Having acknowledged the above, I hereby release and forever discharge the Crane Trust and Carney Photography and its respective employees, agents, volunteers, and affiliates, from any and all claims that may arise out of my participation in Crane Trust experiences or programs. This release includes claims for personal injuries, sickness or disease including, without limitation, COVID-19, conscious suffering, death or property damage to myself or to any other person or property, in any way connected with my participation. This discharge and release applies to all claims based on negligence and any other theory of recovery, except claims based upon willful or intentional misconduct. I acknowledge that I have read the following warning, which is being provided to me by the Crane Trust pursuant to the Nebraska Agritourism Act (Neb. Rev. Stat. § 81-601 et seq.) and I confirm that my activity will be covered by this Act: WARNING - Under Nebraska law, an owner of property, including lands and waters, is not liable for the injury to or death of the participant in agritourism activities or damage to the participant's property resulting from the inherent risks of such activities. Inherent risks include, without limitation, the risk of animals and land and water conditions, the ordinary dangers of structures or equipment ordinarily used in farming or ranching operations, and the potential for you or another participant to act in a negligent manner that may contribute to your own injury or death. You are assuming the risk of participating in the agritourism activities for which you are entering the owner's premises. I HEREBY ACKNOWLEDGE THAT I HAVE FULLY READ EACH OF THE ABOVE PROVISIONS AND FULLY UNDERSTAND AND AGREE WITH EACH PROVISION. I UNDERSTAND THAT I AM GIVING UP LEGAL RIGHTS BY SIGNING THIS LIABILITY AGREEMENT. CRANE PHOTO EXPERIENCE CANCELLATION: If for some unforeseen reason you must cancel your registration, please notify the Crane Trust as soon as possible so we can plan accordingly. A $500 deposit will reserve your spot. Final Payment Deadline: December 16th, 2026. Refunds available if you cancel: 100% until 12/16/2026; 50% before 1/16/2027; No refunds after January 2027. If you are able to find someone to take your place, we do allow substitutions. Given the unpredictable nature of travel, weather and wildlife, the Crane Trust reserves the right to modify the itinerary to give participants the best possible opportunity to photograph and view nature. The Crane Trust also reserves the right to cancel the Experiences due to the lack of minimum attendance requirements and/or safety reasons. In the event the Crane Trust cancels the Experiences, you will receive any amount paid over the non-refundable deposit. The Crane Trust strongly encourages participants to purchase adequate travel insurance. The Crane Trust will not be liable for any other expenses you may incur due to cancellations (such as visas, flights, travel or any other expenses incurred).
